Louisiana, USA, A lawsuit was brought up by BMI for copyright infringement on songs like Brown Eyed Girl, Margaritaville and Every Rose Has it's Thorn...Whom did they sue? Papi's Fajita Factory. This establishment apparently used these tunes with cover bands and during Karaoke without the proper licensing fees. When cover bands perform it is up to the venue to have the necessary licenses. A venue that utilizes a band on Friday and Saturday night in addition to having weekly Karaoke would be responsible for an annual fee of $10.90 PER occupant and $12.70 if the occupants are allowed to dance. This case covers 10 songs. In a previous case BMI won $3000 per count ($21,000 total) from another bar who played their music without a proper license. In 2014 BMI was listed as a plaintiff in 114 cases of copyright infringement. This current case has not been decided yet...
